It is always better not to put yourself into a grey area. A woman who puts herself into this situation should not go and have relations with another man on the side, since it might be that they are considered married in G-d's eyes.

Probably not, if they are not known as a steady couple, and they only have relations occasionally on a purely recreational (i.e. licentious) basis.
